Apple wins order blocking sales of rival tablet

A judge late Tuesday ordered Samsung Electronics Co. to halt sales of its Galaxy 10.1 tablet computer while the court considers Apple's claim the South Korean tech giant illegally copied the design of the popular iPad.

U.S. District Judge Lucy Koh said Apple Inc.'s lawsuit appeared likely to prevail.

"Apple has established a strong case on the merits," Koh said.

Koh had earlier said the two products are "virtually indistinguishable," but she declined in December to take the dramatic step of prohibiting sales of the Galaxy 10.1. She changed her mind after the U.S. Court of Appeals for the Federal Circuit told Koh to take another look at Apple's request for an injunction, ruling June 19 that it appeared the Cupertino-based company had a strong case. The Washington, D.C., court handles most patent appeals.

"Although Samsung has a right to compete, it does not have a right to compete unfairly, by flooding the market with infringing products," Koh wrote in her Tuesday order. She said Apple would be "irreparably harmed" if sales of the Galaxy 10.1 continued.

Samsung said it was disappointed with the court's decision.

"We will take necessary legal steps and do not expect the ruling to have a significant impact on our business operations, as we possess a diverse range of Galaxy Tab products," it said in a statement.

Koh ordered Apple to post a $2.6 million bond in case it ultimately loses the case.

The ruling is a small part of a much larger patent battle between the two tech giants, who are scheduled to go to trial next month in San Jose.

Apple filed its lawsuit last year, and the two companies are enmeshed in patent disputes around the globe revolving around smartphones and handheld computers. Samsung, with its Android-powered products, has emerged as one of Apple's chief rivals.

Apple also accuses the South Korean company of infringing patents related to the iPhone. Apple is seeking a similar injunction barring Samsung from selling one of its smartphones in the United States.

Emma Stone Attracted To Gwen Stacy's 'Spider-Man' Tragedy

'That is so shocking and horrifying and kind of beautiful in some way,' actress tells MTV News of her character's tragic end in the comics.

The news of Emma Stone's casting in "The Amazing Spider-Man" was first met with almost universal approval. She would be the perfect Mary Jane Watson, fans thought. But when her true role as Gwen Stacy became clear, there was almost a bittersweet understanding.

If Gwen is remembered for one thing, it is her death at the hands of the Green Goblin.

When MTV News' Josh Horowitz spoke with the actress, she told him that the tragic end for the character was what initially drew her into the project. "That was part of the reason why I was kind of drawn to the role, that mark on pop-culture history," she said. "I read all about Gwen, and I thought that was so amazing."

Even with Gwen's death as an iconic moment in comic book history, canon is constantly rewritten for film adaptations. Stone sought answers from the filmmakers as to whether the film version of Gwen would respect the book, and she was pleased with the response.

"I spoke to the people behind the movie, and they said, 'Yeah, we're planning on staying true to the comics.' And I was like, 'If you're making a movie like this, that's something I want to be a part of,' " Stone said. "That is so shocking and horrifying and kind of beautiful in some way. The fact that people unsubscribed and burned their copies — I like anything that causes some kind of upheaval."

Her director Marc Webb couldn't say whether Stone's version of Gwen would meet the same fate in an upcoming installment, but he couldn't deny the allure of working with that moment. "I think that remains to be seen, but let me tell you this: The ultimate tragedy of Gwen Stacy is a really provocative and powerful part of the Spider-Man canon," he said. "I think it would be really extraordinary to explore that, but I don't want to take the wind out of the drama."

  • For a brief time in the first half, Paulo Bento switched Nani over to the left, perhaps to help protect against Gebre Selassie?s threat. All that did was give the Czech defender an excuse to get forward. Ronaldo stayed on the left for most of the game.
  • For Portugal, it was just a matter of being patient. Of course, they perpetually tried Ronaldo, with Raul Meireles proving particularly adept at providing for him. As the second half went on, Portugal increasingly tried going down their right, relying on Nani to get the ball into the box.
  • The decisive movement came from the right, though not through a Nani cross. On the ball at the right, Nani turned in and found Joao Moutinho making a run. The Porto midfielder got the ball, burst through the right channel, and played a cross toward the middle. Ronaldo beat Gebre Selassie for the winner.
  • The match was amazingly straight forward: Straight forward because we?re used to one team cowering in the face of (perceived) superior quality; Amazing because it?s unclear why the Czechs chose this approach. This is a nation that?s known for the quality of their soccer, none of which was put on display tonight.
  • Perhaps coach Michal Bilek felt the Czechs couldn?t open up against Portugal. Against Russia, they tried to play with a side that has weapons, and they got run of the pitch. Bilek may have felt he couldn?t take the chance ? that he had a better chance of winning by not playing than playing.
  • It was a warning shot for a team like England, who also beg for games to be decided like this. To be sure, England is better at implementing this type of approach, and they have more ambition going forward than the Czechs showed tonight (as remarkable as that sounds). But when you let the other team have so much of the ball and so many chances, you?re begging for lightning to strike. Sometimes that lightning will be a Samir Nasri blast from 22 yards. Sometimes it will be a Cristiano Ronaldo header bounced home from 10 yards out.
  • Milan Baros just completed the worst major tournament I can remember from a starting number nine. In 360 minutes, he put one shot on goal and didn?t contribute enough in the other facets of the game. His energy level was low, he was unwilling to contest balls in the air, and showed no impetus to improve.
  • If you?re a Czech player, you have to feel as if your coach took the game out of your hands. If you go out and put your best foot forward and are shown out: Fine. This loss leaves too many questions. For years, Czech players may wonder what could have been.
  • Portugal has no such misgivings. They?re through to the semifinals, where they?ll face the winner of Spain-France next Wendesday in Donetsk.

Guilt, Innocence, Other

Usually, punishment is tied to crime. But there are cases when it would be unjust to punish someone who is nevertheless clearly guilty of criminal behaviour. And sometimes on the other extreme, for various reasons, innocent people need to be incarcerated. A third state, other than "guilt" and "innocence" is often used to circumvent the judicial binary. This is the basis of the "insanity" plea.

(I know I talk about insanity a lot, but I think it's something that doesn't get talked about enough, and silence leads to abuses. If I were religious and saw the potential for religion to be abused, I'd talk about that a lot.)

It seems to me that one of the consequences of having the insanity plea is that a huge bank of resources are tied up in making it legitimate. A lot of natural human experience is separated from the ethic of responsibility: for instance, one in five Canadians is, at some point in their lives, insane. Their free agency is legally withheld -- as are their natural right derived from free agency -- sometimes temporarily, sometimes permanently.

We build special jails (hospitals/asylums) for the institutionally irresponsible. We have experts who dedicate years of their lives to figuring out and arbitrating who is and is not responsible for their actions.

Have we gone too far? Should we foster a culture where so many are legally irresponsible? Should we even have the insanity defense? Is insanity real, or a convenient legal fiction? Or is free agency itself just a convenient legal fiction, which should be discarded when harmful?

Researchers at Baylor College of Medicine and Texas Children's Hospital have identified commensal bacteria in the human intestine that produce a neurotransmitter that may play a role in preventing or treating inflammatory bowel diseases such as Crohn's disease.

"We identified, to our knowledge, the first bifidobacterial strain, Bifidobacterium dentium, that is capable of secreting large amounts of gamma-aminobutyric acid (GABA). This molecule is a major inhibitory neurotransmitter in the central and enteric nervous systems," says Karina Pokusaeva, a researcher on the study and a member of the laboratory of James Versalovic.

GABA is one of the chief inhibitory neurotransmitters in the human central nervous system. It plays a role in regulating pain and some pain relieving drugs currently on the market act by targeting GABA receptors on neural cells.

Pokusaeva and her colleagues were interested in understanding the role the human microbiome might play in pain and scanned the genomes of potentially beneficial intestinal microorganisms, identified by the Human Microbiome Project, for evidence of a gene that would allow them to create GABA.

"Lab analysis of metagenomic DNA sequencing data allowed us to demonstrate that microbial glutamate decarboxylase encoding gene is very abundant in intestinal microbiota as compared to other body sites," says Pokusaeva. One of the most prolific producers of GABA was B. dentium, which appears to secrete the compound to help it survive the acid environment.

In addition to its pain modulating properties, GABA may also be capable of inhibiting inflammation. Recent studies have shown that immune cells called macrophages also possess GABA receptors. When these receptors were activated on the macrophages there was a decrease in the production of compounds responsible for inflammation.

"Our lab was curious to explore if GABA produced by intestinal human isolate B. dentium could have an effect on GABA receptors present in immune cells," says Pokusaeva. Together with their collaborators Dr. Yamada and Dr. Lacorazza they found that when the cells were exposed to secretions from the bacteria, they exhibited increased expression of the GABAA receptor in the immune cells.

While the findings are preliminary, they suggest the possibility that B. dentium and the compounds it secretes could play a role in reducing inflammation associated with inflammatory bowel diseases.

The next step, says Pokusaeva is to conduct in vitro experiments to determine if the increased GABAA expression correlates with a decrease in production of cytokines associated with inflammation. GABAA receptor signaling may also contribute to pain signaling in the gut and may somehow be involved in abdominal pain disorders.

"Our preliminary findings suggest that Bifidobacterium dentium could potentially have an inhibitory role in inflammation; however more research has to be performed to further prove our hypothesis," says Pokusaeva.

Rod Roddenberry?s website (where the son of Gene Roddenberry?sells and promotes a lot of Star Trek replica merchandise, among other things) put me onto a new Internet series on gaming.? It?s not?about video games.? It?s about good old-fashioned ?game night? games, board games with dice and cards and tokens,?and it?s called Tabletop.

If you?re a fan of Wil Wheaton, it?s the show for you.? Wheaton is best?known for his role as Wesley Crusher on Star Trek: The Next Generation and as the young star of the Rob Reiner/Steven King film Stand By Me, but he has been quickly branching out as a stellar guest star on series like Leverage (as a superb IT villain) and Big Bang Theory?(where he often plays himself), showing he?s gone beyond the kid actor thing.? And even if you?re not a Wheaton fan?like you thought Wesley Crusher should have been left on Rubicun III?give?this series a?try anyway.

My favorite thing about Wil Wheaton is he seems to thrive at all things geek and nerd.? He?s not apologetic in the least, and in chatting up his love for games and TV and books, he is bringing everyone along for a fun ride.? He?s a regular at San Diego Comic-Con, and I saw him?at a Star Trek writers panel with Star Trek authors?where he showed a?great rapport with fans, and seemed to love talking about what he liked (and didn?t like)?about Trek.

Tabletop?is an?online half-hour, biweekly?series just?beginning and?in its first five episodes, which?is a bit like Comic Book Men and Celebrity Poker, but far, far better than both of those shows.? In fact, the introduction, production values, and content should get some network exec to take notice.??This is the first online-only?series we?ve taken note of here at borg.com that?we think is worthy of?another look and we?think a wider audience is out there for this show.

Tabletop has host Wheaton playing a few board or dice?games with some friends, including explaining quickly and clearly the game?s rules, and just chatting it up around the table with people like Rod Roddenberry, Felicia Day (Buffy the Vampire Slayer, Monk, House, M.D., Eureka), Colin Ferguson (Eureka), ?Grant Imahara (Mythbusters), James Kyson (Heroes, Hawaii 5-0), and Neil Grayston (Eureka).? I think it would?be an interesting twist to add in other celebrities, maybe genre actors or legends Wheaton himself?is a fan of, but may not previously know personally.? I?d love to see someone like Billy Mumy do an episode and see what these guys would talk about while playing Apples to Apples, or pull some obscure old games out of the game closet that are long forgotten but still fun, like Bionic Crisis or the Star Wars board game.

Which brings us to the episode with Rod Roddenberry, where they covered a few games including Tsuro.? The episode intrigued me enough that I wandered past a game shop this weekend while hanging out with family and I bought it.? We were able to pull?out the board and playing pieces and start playing at a local coffee shop in minutes.? Just as I?had discovered?watching the players?in the episode of Tabletop,?Tsurois a blast.? In a nutshell, you have 35 cardboard tiles that?players lay out one by one, in turn, and each tile has a different set of paths, some straight, some crisscrossed, some coming back at you.? The goal is to?create a path for yourself and maybe even knock?others off the board and?be last?player on the board.? Even the barista stopped by and commented how awesome the game looks (it has the beautiful Chinese red dragon baord,?parchment divider page, and cool rune playing tokens) and I passed along Wheaton?s show and the game shop across the street that had one more copy in stock.

We?ve played it three times fo far and I can?t wait to play Tsuro again.? Thanks, Wil Wheaton!

Actor-comedian Tommy Chong, one-half of the pot-loving pair ?Cheech and Chong,? said he?s treating his ?slow stage-one? prostate cancer with his favorite plant.

?I?ve got prostate cancer, and I?m treating it with hemp oil, with cannabis,? Chong, 74, told CNN Saturday. ?So [legalizing marijuana] means a lot more to me than just being able to smoke a joint without being arrested.?

Chong told the news site that he was diagnosed with the illness about a month ago, but he first experienced symptoms of the cancer about eight years ago while in jail after selling drug paraphernalia.

He no longer smokes marijuana because of ?health reasons,? he told CNN, and he consumes the hemp oil at night so he ?won?t be woozy all day.?

Cannabis has been approved by the U.S. Food and Drug Administration to relieve symptoms of nausea and vomiting, and to help increase appetite in people with cancer and AIDS, according to the American Cancer Society. The most potent ingredient of medical marijuana is THC. The product comes in the form of an inhaler, pills and oil and it can also be smoked.

There are no other drugs that work as well as cannabis for treating the nausea and anorexia associated with cancer and its treatments, Dr. Donna Seger, associate professor of clinical medicine at Vanderbilt University School of Medicine in Nashville, Tenn., told ABCNews.com in March.

It is unclear whether Chong has undergone chemotherapy or other treatments for the cancer, but treatment of stage 1 prostate cancer, which is only found in the prostate,??is often approached by the ?watchful waiting? technique, when doctors allow time to pass to see the progression of the disease before they suggest surgery or medical intervention.

At least one doctor believes Chong?s promoting his self-described treatment is a disservice to other men with the disease.

?As a comedian, this is a really funny skit,? said Dr. Leonard G. Gomella, chairman of the department of urology at Thomas Jefferson University in Philadelphia. ?As a public figure who can get a forum, it is irresponsible. Had he been suffering from widely metastatic disease with bone pain and other devastations, perhaps there may be a role, but not for early disease.?

Apple closes in on $2.25 million settlement in Australia for disputed 4G iPad claim

The legal drama surrounding Apple's 4G labeling of some iPad models in Australia might be coming to an end. The Australian reports that Apple has agreed to pay $2.25 million to settle claims that the company's use of the term "Wi-Fi + 4G" was misleading because the tablet doesn't work with the country's 4G networks. Apple already offered to provide refunds to consumers who felt deceived by the labeling. The company also renamed the aforementioned model to "iPad WiFi + Cellular" in several territories. Apple hasn't quite made it across the finish line, however -- the settlement still requires court approval before it can be finalized and the Judge has adjourned the case until Wednesday to gather more information.

Suicides surging among US troops; Pentagon scrambles to do more (+video)

WASHINGTON ? Suicides are surging among America's troops, averaging nearly one a day this year ? the fastest pace in the nation's decade of war.

The 154 suicides for active-duty troops in the first 155 days of the year far outdistance the U.S. forces killed in action in Afghanistan ? about 50 percent more ? according to Pentagon statistics obtained by The Associated Press.

The numbers reflect a military burdened with wartime demands from Iraq and Afghanistan that have taken a greater toll than foreseen a decade ago. The military also is struggling with increased sexual assaults, alcohol abuse, domestic violence and other misbehavior.

Because suicides had leveled off in 2010 and 2011, this year's upswing has caught some officials by surprise.

The reasons for the increase are not fully understood. Among explanations, studies have pointed to combat exposure, post-traumatic stress, misuse of prescription medications and personal financial problems. Army data suggest soldiers with multiple combat tours are at greater risk of committing suicide, although a substantial proportion of Army suicides are committed by soldiers who never deployed.

The unpopular war in Afghanistan is winding down with the last combat troops scheduled to leave at the end of 2014. But this year has seen record numbers of soldiers being killed by Afghan troops, and there also have been several scandals involving U.S. troop misconduct.

The 2012 active-duty suicide total of 154 through June 3 compares to 130 in the same period last year, an 18 percent increase. And it's more than the 136.2 suicides that the Pentagon had projected for this period based on the trend from 2001-2011. This year's January-May total is up 25 percent from two years ago, and it is 16 percent ahead of the pace for 2009, which ended with the highest yearly total thus far.

Suicide totals have exceeded U.S. combat deaths in Afghanistan in earlier periods, including for the full years 2008 and 2009.

The suicide pattern varies over the course of a year, but in each of the past five years the trend through May was a reliable predictor for the full year, according to a chart based on figures provided by the Armed Forces Medical Examiner.

The numbers are rising among the 1.4 million active-duty military personnel despite years of effort to encourage troops to seek help with mental health problems. Many in the military believe that going for help is seen as a sign of weakness and thus a potential threat to advancement.
